These Terms and Conditions (“Terms”) govern your use of the SaaS platform and related services (the “Services”) provided by Boostly Ltd. (“Boostly”, “we”, “us”, or “our”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not misuse the platform by knowingly introducing viruses or attempting unauthorized access.

4.Subscription & Payment

Our Services are offered on a subscription basis. Pricing is outlined on our website and may be updated from time to time. All payments are due in advance and are non-refundable, unless otherwise stated in a separate service agreement.

5.Data Ownership

You retain ownership of all content and data you upload. Boostly Ltd. does not claim any rights to your intellectual property. However, you grant us a limited license to use this content for the purpose of providing and improving our Services.

6.Service Availability

We aim for 99.9% uptime. However, we may occasionally suspend access for maintenance, upgrades, or unexpected downtime. We are not liable for any loss or damages due to service interruptions.

7.Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may also cancel your subscription at any time, but no refunds will be issued for the remaining subscription period unless explicitly stated.

8.Limitation of Liability

To the fullest extent permitted by New Zealand law, Boostly Ltd. is not liable for any indirect, incidental, or consequential damages, including loss of data, revenue, or business opportunities, arising from the use or inability to use our Services.

9.Indemnification

You agree to indemnify and hold Boostly Ltd. harmless from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Services or your violation of these Terms.

10.Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of New Zealand courts.

We may update these Terms from time to time. We will notify you of significant changes via email or via the platform. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
